TEXAS LEMON LAW

Dealers - Manufacturers Clash Over Turning to Law Makers to Solve Problems

There is a growing trend among RV dealers to take their frustration with manufacturers to state legislatures instead of resolving the problems through negotiations. In the past year there have been several conflicts where dealers sought laws to force manufacturers to concede on franchise issues.
At the recent RVIA annual meeting, David Humphreys, president of RVIA, told members, “We are at war in Texas!” He described a pending law that would bring towable RVs under the state’s Lemon Law as the issue.
RV News believes both dealers and manufacturers have legitimate issues that need resolving. RV News also believes the problems are complex, so in an effort to bring these concerns before the industry we asked four industry representatives to express their views on the subject. The following opinions hopefully will give the reader a better understanding of what’s at stake, who wins and who loses.
